Include My Rent Consent to Electronic Records

Please read this information carefully and retain a copy for future reference.

Introduction - To the extent permitted by law, Include My Rent will provide all disclosures and notices to you in electronic form including, but not limited to, the credit-related disclosures required by the Truth in Lending Act, and any notices (e.g., adverse action notice and privacy policy notice) required by the Fair Credit Reporting Act, Equal Credit Opportunity Act, and Gramm-Leach-Bliley Act, and their implementing regulations. For purposes of this consent, these disclosures and notices are referred to as "Records." This Consent to Electronic Records informs you of your rights when Records will be provided to you electronically. By consenting below, you acknowledge receipt of this Consent to Electronic Records and agree to the electronic delivery of the Records. Hardware and Software

Requirements - The Records will be provided to you either on the Include My Rent website, in an email message, or as an attachment to an email message sent to the email address you provide as part of your application. To access the Records, you will need personal computer or other access device which is capable of accessing the Internet with a web browser. To retain the Record, your access device must have the ability to either download the Records to your computer's hard drive or print the Records.

Right to Withdraw Consent and Procedures for Withdrawal - You may withdraw your consent to receive the Records electronically at any time, or update your contact information at any time by emailing support@includemyrent.com or writing to 851 E. 165 Service Road. S. 10th Floor, Suite 1080, Mobile, AL 36606 and withdrawing your consent or providing your updated contact information.

Consent Applies to Credit Transaction - Your Consent to Electronic Records applies to the credit transaction you've requested and any other product or service you may request from Include My Rent that may give rise to the obligation to provide the Records.

Right to Paper Records and Copies of Records - You have the right to have the Records provided to you in paper form, rather than electronic form. Include My Rent Affiliate Program

AFFILIATE AGREEMENT
This agreement describes the terms and conditions for participation in the Include My Rent Corporation Include My Rent Affiliate Program. The terms "Affiliate," "you," and "your" are referring to you, the applicant. "We" and "our" refer to Include My Rent.  We are independent parties and this agreement will not form any partnership.

AGREEMENT DURATION
The term of this Agreement will begin upon our acceptance of your Affiliate Program application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all Links to our site, and all Include My Rent trademarks, logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the Program. You are only eligible to earn commissions on processed applications occurring during the term, and commissions earned through the date of termination will remain payable only if the related Include My Rent application is not canceled. We may withhold your final payment for a reasonable time to ensure that the correct amount is paid.

MODIFICATION
By posting a Change Notice or a new agreement on this site, we may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM following the posting of a Change Notice or new agreement, it will be considered as your acceptance of the change.

COMMISSION FEES
You will receive a commission from the completed applications placed through your Affiliate Site.  Click here to view and print. 

For a sale to generate a commission to an Affiliate, the customer must complete the application and remit first payment in full. Affiliate commissions will only be paid on applications which are made through qualified Affiliates. Any returned checks, chargebacks, or fees from a returned order will be adjusted in the following fee payment. If no fee payment is due a billing invoice for the amount will be issued.
*Please note that NO COMMISSION is paid on your personal loan application of Include My Rent.
 
Although we will endeavor to pay much faster, commission shall be paid within 35 days after the end of the current pay period. Include My Rent shall not be obligated to make any payment to Affiliate until it has received payment from customer. Any earned but unpaid Commissions shall carry over to the next regularly scheduled payment period.  It is the current policy, as of January 1, 2025 to pay commissions on a monthly basis.  A "pay period" is defined as a calendar month. 

ORDER PROCESSING
Include My Rent will be solely responsible for processing every loan application placed by a customer on the Affiliate sites. Customers who apply for a loan through the Affiliate Program will be deemed to be customers of Include My Rent.
Prices and availability of our products and services may vary from time to time. Include My Rent's policies will always determine the price paid by the customer. We reserve the right to reject any loan that does not comply with our rules, operating procedures and policies.
We will be responsible for tracking the volume and amount of sales generated by your site, and for providing information to Affiliate Sites regarding sales statistics through a monthly commission schedule which will be emailed the week following that pay-period.
It is imperative that you as an affiliate are aware that Include My Rent will not accept CPN or TIN numbers for applications.  If your client uses these fraudulent practices to attempt to gain a line of credit, their application will be rejected, and a refund may not be forthcoming.  You will not be allowed to receive a commission for this type of sale and your Affiliate Relationship with Include My Rent is subject to termination. 

WEBSITE RESTRICTIONS
Include My Rent reserves the right not to accept any site into the Include My Rent based on site content. Sites that Do Not Qualify for the Include My Rent Affiliate Program include sites that are:

• X- rated and promote sexually explicit materials
• Promoting violence and discord.
• Promoting discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• Promoting illegal or questionable activities
• Violating intellectual property rights

LINKS ON YOUR SITE
As an Affiliate Site, we will make available to you a variety of graphic and textual links (each of these links sometimes being referred to herein as "Links" or, individually, as a "Link"), which, subject to the terms and conditions hereof, you may display as often and in as many areas on your site as you desire. The Links will serve to identify your site as a member of our Affiliate Program and will establish a link from your site to ours. The Links may connect to different areas of our site. In utilizing the Links, you agree that you will cooperate fully with us in order to establish and maintain such Links. You also agree that you will display in your site only those graphic or textual images (indicating a Link) that are provided by us, and you will substitute such images with any new images provided by us from time to time throughout the term of this Agreement. All Affiliate Sites shall display such graphic and/or textual images prominently in relevant sections of their site. All Links may be modified and/or expanded from time to time throughout the term of this Agreement pursuant to the mutual agreement of the parties hereto. Each Link connecting users of your site to the pertinent area of our site will in no way alter the look, feel, or functionality of our site. You will only earn referral fees with respect to activity on our site occurring directly through said Links. We will not be liable to you with respect to any failure by you to use these Links, including to the extent that such failure may result in any reduction of amounts that would otherwise be paid to you pursuant to this Agreement.

 ADVERTISING
You may not, under any circumstances, without written permission from Include My Rent , use the following keywords, adwords or in any way utilize these words on the internet or in any other form of media except those banners and text links provided for affiliate use: Include My Rent,

PUBLICITY
You shall not create, publish, distribute, or permit any written material that makes reference to us without first submitting such material to us and receiving our written consent.

 SPAM (UCE)
Unsolicited Commercial E-mail - Include My Rent in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the Include My Rent Affiliate Program, with no refund.

 SPYWARE AND OTHER PARASITES
Any affiliate suspected of a relationship, formal or informal, with any provider of spyware or parasitic software (as judged by any interference with the operation by design of MERCHANT and/or its partner sites) is subject to punitive actions by MERCHANT, without notice, including but not limited to: suspension of affiliate account; termination of affiliate account; withholding of payments to affiliate; and public notification of affiliate's suspected malfeasance. MERCHANT encourages affiliates to report suspicions of such relationships; and, should substantial proof, as judged by MERCHANT, be provided, MERCHANT reserves the right to assign a value equal to unpaid monies earned by the offending affiliate (or a part thereof) to the reporting affiliate as a bounty.

 DISCLAIMER
We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Include My Rent Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or downtime.

This Agreement will be governed by the laws of the United States and the State of Alabama, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the Federal or State courts located in Hendersonville Nevada, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By submitting this Affiliate Agreement form, you acknowledge that you have read this agreement and agree to all its terms and conditions. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEBSITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE AFFILIATE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
